Law 21.160, which declares sexual offenses committed against minors as non-prescriptible, was published in July 2019. The legislation introduces modifications to the Penal Code, establishing the non-prescriptibility of criminal action concerning sexual crimes and simple sexual offenses committed against children and adolescents. Under the previous law (No. 20.207 of August 2007), these offenses could be subject to prescription, with the clock starting once the victims turned 18.
Additionally, the new law establishes a series of special rules related to the renewal of the civil reparative action derived from such offenses and its admissibility against the accused or the person responsible for the offense.
