Enacts the Convention on the Civil Aspects of International Child Abduction

The Hague Convention on the Civil Aspects of International Child Abduction was adopted on October 25, 1989, and ratified in Chile through Decree 386 on June 17, 1994. The Convention aims to ensure the immediate return of children who have been wrongfully removed to, or retained in, any Contracting State, as well as to effectively enforce in other Contracting States the rights of custody and access existing in a Contracting State. The goal is to protect the child, on an international level, from the harmful effects of wrongful removal or retention, and to establish procedures to guarantee the child’s immediate return to the State of their habitual residence, as well as to ensure the protection of the right of access.
