Law 21.057, which “regulates Videorecorded Interviews and other measures to safeguard children victims of sexual crimes“, was published in January 2018 with the aim of safeguarding the rights of child and adolescent victims of sexual crimes and other serious crimes, as well as to prevent the secondary victimization that may affect them in their transit through the criminal justice system. The Act incorporates a series of changes to the judicial processes in which children and adolescents participate. Some of the most relevant ones are the modifications to the complaint procedure, and the incorporation of the Videorecorded Interview in the investigation stage and the Judicial Intermediation in the trial stage. It also establishes that all of the interactions with children and adolescents during these three stages must meet the following principles: best interests of the child, progressive autonomy, voluntary participation, prevention of their secondary victimization, timely assistance and preferential processing of all interventions, and protection of the dignity of the victims.
