Law 21.430 on Guarantees and Comprehensive Protection of the Rights of Children and Adolescents was published on March 15, 2022. Its objective is to guarantee and provide comprehensive protection of the rights of children and adolescents (CNA), as recognized in the Political Constitution of the Republic, the Convention on the Rights of the Child, and other international treaties ratified by Chile that are in force, as well as in the laws. What does the Law entail?
The Law creates the System of Guarantees and Comprehensive Protection of the Rights of Children and Adolescents, which will consist of a set of policies, institutions, and regulations aimed at respecting, promoting, and protecting the physical, mental, spiritual, moral, cultural, and social development of children and adolescents, to the fullest extent of the resources available to the State.
This system, composed of the Courts of Justice, the National Congress, the State Administration bodies, the Children’s Rights Defender, and several other institutions, seeks to carry out actions of protection, promotion, prevention, restitution, or reparation for the access, exercise, and effective enjoyment of the rights of children and adolescents.
Chile is no longer the only country in Latin America that lacked a Guarantee System for children and adolescents, according to the standards defined by the Convention on the Rights of the Child.
