The Decree-Law No. 321, which establishes parole for individuals sentenced to prison sentences, was published on March 12, 1925, with the aim of regulating its granting to individuals based on the progress of their social reintegration processes. The last modification to this regulation was made in January 2019 through Law 21.124, which granted parole the status of a benefit, increased the requirements for applying for it in cases of femicide and rape of individuals over fourteen years old, and included the requirement for a psychosocial report from the Chilean Gendarmerie.
In September 2020, the regulation of this legislation was published in the Official Gazette – Decree 338 from the Ministry of Justice and Human Rights – establishing the rules regarding the organization of the parole system, the Gendarmerie of Chile’s reports, and the characteristics and requirements that parole delegates must meet.
